Davie Man Sentenced to Long Prison Term for DUI Manslaughter
Jordan Fuss had been drinking rum before deciding to drive his 2004 Infiniti G35 along with his passenger who supplied him with the intoxicating beverage. Marijuana was also found in his system after it was later tested.
It was just before midnight in the early autumn of 2014.
According to police, Fuss was driving his vehicle in excess of ninety miles per hour when he slammed into another car at the intersection of Stirling and Davie Roads.
Witnesses to the crash told police that the car was swerving between lanes before hitting the other car at the crossing of the two major thoroughfares. They also said he didn’t slow down as he approached the crossing causing what sounded like an explosion to many of the witnesses. One of the police officers on the scene said he smelled a strong odor of an alcohol emitting from Fuss’s facial area.
The impact of the collision caused the back of the other car to be crushed and virtually split in two.
Inside were Nancy Saavedra, her 14-year-old daughter, and 6-year-old son. Mother and daughter survived the crash but young Santiago Mondragon who was strapped into a car seat in the back of the vehicle was pronounced dead at the scene. The father, Gustavo Mondragon was not in the car at the time of the crash.
Fuss was charged with vehicular homicide, reckless driving and DUI manslaughter.
His blood-alcohol level tested at 0.21 percent, almost three times the legal limit.
Fuss was hoping for a reduced sentence after pleading guilty to the charge of DUI manslaughter. His remorse was evident and his attorney told the judge that he knew his client was going to prison but pleaded for mercy on his behalf. During testimony, Fuss continually apologized to the family, at one point saying “I’m so sorry,” he said. “I wish it was me.”
But after weighing the totality of the crime, out of a maximum of a fifteen year punishment, the judge sentenced the tearful 21-year old to fourteen years and six months in a Florida state prison earlier this year (2017).
